Terms of Service

These Terms of Service ("Terms") govern your use of the Trail Kos mobile application and related website at https://trailkos.devolist.com. By using Trail Kos, you agree to these Terms. If you do not agree, do not use the app.

1. About Trail Kos

Trail Kos provides hiking trail information, maps, offline downloads, guided hike listings, safety content, and optional Premium features for Kos, Greece. Content is compiled from public sources, partners, GPS surveys, and editorial research.

Trail and safety information is general guidance only. It is not professional mountaineering, medical, or legal advice. Conditions change daily — always assess weather, terrain, fitness, and local regulations before hiking.

2. Eligibility

You must be at least 13 years old (or 16 in the EEA where applicable) to create an account. If you are under 18, you must have a parent or guardian's permission.

3. Accounts

You are responsible for your credentials and all activity under your account. Provide accurate information. Notify us immediately at [email protected] if you suspect unauthorised access.

4. Acceptable use

You agree not to:

Misuse trails, harass other users, or submit false reports
Scrape, reverse engineer, or overload our systems
Use the app for unlawful purposes
Redistribute paid Premium content or offline map packs without permission

We may suspend or terminate access for violations.

5. Trail content and liability

Distances, difficulty ratings, durations, and routes are estimates.
Trails may be closed, overgrown, or dangerous without notice.
You hike at your own risk. Trail Kos is not liable for injury, loss, or damage arising from outdoor activities, weather, wildlife, or third-party services.
Emergency features (e.g. SOS links) supplement but do not replace official emergency services.

6. Guided hikes and bookings

When you book a guided hike through the app:

You enter into a service arrangement with the trip operator shown in the booking flow.
Confirmation, meeting points, cancellation, and refunds are subject to the operator's rules and our Refund & Cancellation Policy.
We facilitate booking and payment processing but are not the tour operator unless explicitly stated.

7. Premium and payments

Premium features, subscription terms, billing, and cancellation are described in our Terms of Use (EULA) and Refund & Cancellation Policy.

8. Advertising and partners

The app may show Google AdMob ads, sponsor listings, and affiliate links (e.g. travel eSIM partners). Third-party content is provided by those parties under their own terms and privacy policies.

9. Intellectual property

Trail Kos content, branding, maps, and software are protected by copyright and other laws. You receive a limited personal licence to use the app as described in the EULA. Do not copy or resell our content.

10. Disclaimer of warranties

The app is provided "as is" and "as available" to the fullest extent permitted by law. We do not guarantee uninterrupted service, accurate GPS positioning, or complete trail coverage.

11. Limitation of liability

To the maximum extent permitted by law, Trail Kos and its operators are not liable for indirect, incidental, special, or consequential damages, or for losses arising from hiking, travel, or reliance on app content. Our total liability for any claim is limited to the greater of (a) amounts you paid us in the 12 months before the claim, or (b) €50.

Nothing in these Terms limits liability that cannot be excluded under applicable law.

12. Changes

We may update these Terms from time to time. The current version is at https://trailkos.devolist.com/terms. Material changes will be reflected by updating the effective date. Continued use constitutes acceptance.

13. Governing law

These Terms are governed by the laws of Greece, without regard to conflict-of-law rules, except where mandatory consumer protections in your country of residence apply.
